Trustee Duties Under South Carolina’s Trust Code

South Carolina’s Trust Code sets out several specific fiduciary duties that a trustee must meet throughout the administration. These are legal obligations owed to beneficiaries, and understanding them is the starting point for every trustee.

Core Statutory Duties

Duty to Administer & Loyalty
Under Section 62-7-801, a trustee must administer the trust in good faith, in accordance with its terms and purposes, and in the interests of the beneficiaries. Section 62-7-802 requires undivided loyalty to those beneficiaries, prohibiting transactions that benefit the trustee personally at the trust’s expense.

Impartiality & Prudent Administration
Section 62-7-803 requires the trustee to act impartially when the trust has multiple beneficiaries with competing interests. Section 62-7-804 imposes a prudent-administration standard: investment and management decisions must reflect the care a reasonably prudent person would exercise.

Recordkeeping & Separation of Assets
A trustee must keep trust property separate from personal assets and maintain clear, accurate records throughout the administration period.

Duty to Inform & Report
Section 62-7-813 requires the trustee to keep beneficiaries reasonably informed about the trust and its administration, including providing requested accountings. A distributee or permissible distributee may waive the right to a trustee’s report and other information and may later withdraw that waiver as to future reports.

Trustee Compensation
Compensation follows the trust instrument first. When the instrument is silent, the trustee is entitled to reasonable compensation for services rendered.

The Trust Administration Process in South Carolina

After a grantor’s death, the successor trustee takes on immediate responsibilities. The practical work involves marshaling assets, managing investments prudently during the administration period, communicating with beneficiaries, paying valid debts and taxes, and ultimately distributing assets according to the trust’s terms.

Court Involvement & Venue

Charleston County Probate Court may have exclusive jurisdiction over proceedings concerning the internal affairs of a trust when an interested party brings a matter before it. A proceeding of this kind doesn’t result in ongoing court supervision of the trust. Venue for any judicial proceeding may be the South Carolina county where the trust’s principal place of administration is located.

Nonjudicial Settlement Agreements

Not every dispute or administrative question requires a court filing. South Carolina law allows interested persons to resolve certain trust matters through a binding nonjudicial settlement agreement. These agreements can cover approval of a trustee’s accounting, direction to a trustee on an administrative act, trustee resignation or appointment and compensation, and transfer of the trust’s principal place of administration, among other matters.

Decanting Authority

Under Section 62-7-816A, South Carolina trustees may, under specified conditions, appoint the property of an existing trust into a second trust. This authority, sometimes called decanting, can allow a trustee to modify administrative terms when circumstances have changed since the original trust was drafted.
