A DUI conviction in South Carolina can carry mandatory jail time, fines, and license suspension, even for a first offense. Many people are surprised to learn that South Carolina has some of the strictest DUI laws in the country.
For a first DUI offense, penalties may include:
- 48 hours to 90 days in jail
- Fines ranging from $400 to $1,000
- License suspension up to six months
Second and third offenses bring dramatically harsher consequences, including multi-year prison exposure and fines up to $10,000. A fourth offense can result in permanent license forfeiture.
DUI penalties also increase based on blood alcohol concentration (BAC). Drivers who register 0.15 or higher face additional restrictions under Emma’s Law, including mandatory ignition interlock devices.
